
A MAN has gone on trial accused or raping his girlfriend's best friend five years ago. Ari Karim, 31, is accused of carrying out the attack at his then home in Great Thornton Street, Hull, on June 23, 2008.
A jury at Hull Crown Court was told that the girl, who was 16 at the time and cannot be identified for legal reasons, had spent the night at the flat because she was friends with Mr Karim's then girlfriend, who was 17 and also in the flat.
The younger girl went to sleep on a duvet on the floor and woke up to find Mr Karim on top of her having sex with her, the court heard.
She said she had gone to sleep in the early hours fully dressed but woke up to find her knickers around her right ankle and her tights had been taken off.
In a DVD of a police interview that was played to the jury, the woman said: "I woke up and he's on top of me.
"He'd taken my tights off, my underwear off.
"I was really shocked and really quiet because I didn't know what was going on."
She said she normally slept on her side but was "sprawled out" on her back when she woke.
"I didn't even notice my tights had been taken off until he pulled them up for me," she said.
The first thing she saw when she woke was his arm and, although it was dark, she knew it was Mr Karim because his arm was muscular, she said.
The girl said she had drunk about three glasses of vodka and Coke, which she poured herself, and was "merry" and "tipsy" but not drunk.
A female police officer who conducted the DVD interview asked her: "At any point, did you give him consent to be having sex with you?"
"I was asleep," the girl replied. "No, never."
The girl said she pushed Mr Karim off and turned her back on him.
At 4.37am, she texted her sister with the words: "You best be awake, I need you.
"Ring me now please, please. It's more than urgent, please."
She received a text back asking what it was about, to which she replied: "Right, I was asleep and I woke up with Ari on top of me. He took all my clothes off and was trying to have sex with me when I was asleep but I woke up."
They spoke, with the alleged victim "upset and speaking really quiet", then arranged to meet in a park nearby.
The sister then went round to the flat to confront Mr Karim, who was naked in bed.
The sister, who gave evidence from behind a screen so the defendant could not see her, said she asked Mr Karim what had happened.
Mark McKone, prosecuting, asked her: "Did he give you an answer?"
"No," she replied.
"How did he look?" Mr McKone asked.
"He was just kind of grinning," the sister said.
The prosecution say the alleged victim's DNA was found on the inside of Mr Karim's boxer shorts, which were seized when he was arrested at 7.50am the next day.
Mr Karim, of Mossborough Crescent, Birmingham, was arrested for a second time on August 24 last year.
Asked in interview how the girl's DNA came to be on the inside of his boxer shorts, he replied "No comment," which was the answer he gave to all other questions.
Mr Karim denies rape and the trial continues.
